POLICY WIRE — Phoenix, United States — An Arizona man’s 10-year manslaughter sentence has been overturned in a case where an artificial intelligence-generated video depicted the deceased victim addressing a judge before the punishment was imposed.
The Arizona Court of Appeals ruled that Gabriel Paul Horcasitas must be resentenced for the 2021 shooting death of Christopher Pelkey because the AI video was deemed unreliable. The court found that the footage did not accurately reflect events and presented statements as if they came directly from the victim.

The AI-generated video, created by Pelkey’s family, was used to give the victim a voice during sentencing. However, defense attorneys argued that the video violated due process by not allowing Horcasitas to challenge its content.
