The incident occurred last June when Caylin Tucker dined with her parents at a Houston-area restaurant. Before ordering, she informed the server about her severe peanut allergy and requested a meal free of peanuts. The waiter reportedly confirmed the request could be fulfilled, but the dish she received was later found to be “smothered in peanut sauce,” according to a civil complaint filed in Harris County District Court.

Tucker immediately experienced swelling of her lips and tongue, followed by difficulty breathing and hives, which led to anaphylaxis. She required emergency medical treatment and claims she endured physical pain, emotional distress, and long-term impairment. The lawsuit accuses the restaurant and its staff of failing to follow proper allergen protocols, including not properly documenting her allergy and failing to check the food before serving it.
