POLICY WIRE — McAllen, Texas — A federal judge has denied a request to block the Trump administration’s land swap with SpaceX, allowing the aerospace company to acquire more than 700 acres of wildlife refuge in Texas.
The decision by U.S. District Judge Fernando Rodriguez Jr. came after environmental groups argued that the deal would harm the Lower Rio Grande Valley National Wildlife Refuge, a critical habitat for numerous species and historical landmarks. The judge found that the plaintiffs failed to provide sufficient evidence of ecological harm, stating their claims were relatively weak.

Under the agreement, SpaceX would exchange its 683-acre property for federal land within the 103,000-acre refuge, which spans four counties along the Texas-Mexico border. Environmental advocates criticized the swap as a “gift” to SpaceX, warning it could lead to significant damage to the protected area. However, the Fish and Wildlife Service maintained that the exchange would result in a “net conservation benefit” and improve habitat connectivity in the region.
