DHS Secretary Markwayne Mullin stated that the individual who was shot, Oscar Bergal, was responsible for putting the child’s life at risk. He emphasized during a press briefing that Bergal was aware of the child’s presence in his car, though the officers were not.

According to a timeline provided by Executive Associate Director Marcos Charles, ICE agents attempted to arrest Bergal on Thursday afternoon. They used two vehicles to block his car, but he refused to exit and instead accelerated into the ICE units. The officers then fired their weapons, believing their lives and those of others were in danger. Bergal was taken to the hospital after being struck in the neck and is currently in stable condition, according to NYPD Commissioner Jessica Tisch.
