Justice Sonia Sotomayor Hopes for Reversal of Supreme Court Presidential Immunity Ruling
Supreme Court Justice Sonia Sotomayor criticizes the court's ruling on presidential immunity and urges American voters to remain active in the democracy.
POLICY WIRE — Mount Vernon, USA — Supreme Court Justice Sonia Sotomayor has expressed a desire for the high court to reverse certain recent decisions, specifically targeting the ruling that provides former presidents with broad protections from criminal prosecution.
Speaking at a civics education event at George Washington’s Mount Vernon estate on Saturday, the justice noted that her colleagues have engaged in crazy things. She remarked that while she frequently dissents, she hopes the court eventually retracts some of its actions, clarifying that her comment was not entirely joking.
Sotomayor emphasized that there are specific legal opinions she hopes to see overturned during her lifetime, citing the immunity case as a primary example. In 2024, the Supreme Court ruled 6-3 that the core of a president’s powers are shielded from criminal charges.
Sotomayor joined liberal justices Elena Kagan and Ketanji Brown Jackson in disagreeing with that decision. In her formal dissenting opinion, Sotomayor argued that the ruling effectively positioned Donald Trump and future presidents as a “king above the law.”
The justice also addressed the high voter turnout seen in recent midterm elections, stressing the necessity of participation in the democratic process. She told the audience that there is no valid justification for failing to vote and that political apathy is not an acceptable stance.
As a member of the board for iCivics—an organization established by the late Sandra Day O’Connor—Sotomayor highlighted the vital role of civic education. She voiced concern over the current trajectory of American democracy, suggesting that restoring balance to stability will require significant effort.
Reflecting on the major shifts in the Supreme Court’s legal philosophy across various domains, Sotomayor predicted that while the current era will eventually settle, a new legal order will emerge that the public will come to understand.
