Fired FBI Agents Sue for Reinstatement, Alleging Political Retaliation in Trump Documents Probe
Nine FBI agents and analysts fired after investigating Donald Trump's classified documents case sue for reinstatement, citing unlawful political retribution.
POLICY WIRE — Washington, D.C. — A group of nine FBI agents, intelligence analysts, and staff operations specialists filed a federal lawsuit on Thursday seeking to reclaim their positions. The plaintiffs, who were terminated in February, allege their dismissals were acts of unlawful political retribution stemming from their involvement in the investigation into former President Donald Trump’s handling of classified records at his Mar-a-Lago estate.
The legal challenge expands the ongoing conflict between the current FBI leadership under Director Kash Patel and personnel who participated in high-profile investigations involving the Republican president. The lawsuit asserts that the plaintiffs, who possess over a century of combined experience, were fired without proper notice, hearings, or disciplinary processes, despite their distinguished service on critical national security matters.
Attorneys for the group, including Margaret Donovan, Abbe Lowell, and Rebecca Tinio, stated that their clients were targeted for performing their duties with impartiality. The complaint argues that the administration incorrectly presumed the agents’ personal political convictions influenced their work on the investigation, which was internally codenamed Plasmic Echo.
The lawsuit details how the investigation into the improper storage of classified documents at the Florida estate led to a 2022 search and subsequent federal indictment. Although that case was later dismissed by Judge Aileen Cannon, the plaintiffs maintain they were assigned to the probe as part of their standard counterintelligence duties and are now seeking back pay and a formal declaration that their terminations were illegal.
