The incident occurred in August 2025 at the Colossus II facility in Memphis, Tennessee, which was developed by xAI before being integrated into SpaceXAI. The lawsuit, obtained by The Commercial Appeal, claims that safety measures were lacking at the site.

According to the legal document, Alexis Vicent, an employee of Employer Solutions Staffing Group, fell approximately 25-30 feet onto a concrete floor on his first day at the facility. The suit alleges that no fall protection systems were in place, including guardrails, harness tie-off points, or warning signs. He later died in Florida in February 2026.
