No Charges for Arizona Parents After Toddler Declared Dead, Found Alive

POLICY WIRE — Phoenix, Arizona — Arizona authorities have decided not to press charges against the parents of a toddler who was mistakenly declared dead at a local hospital but later found to be alive. The incident, which occurred earlier this month, prompted the Phoenix Police Department to recommend negligence charges against the parents. However, the Maricopa County Attorney’s Office has declined to pursue the case.

According to police reports, the child was brought to the hospital exhibiting signs of distress. Medical staff pronounced the toddler dead upon arrival. However, a subsequent examination revealed that the child was, in fact, alive. The circumstances leading to the erroneous declaration remain under investigation.

Phoenix Police Department spokesperson Sgt. Ann Justus stated, “Our investigation indicated that there may have been negligence on the part of the parents in seeking timely medical attention.” Despite this recommendation, County Attorney Allister Adel decided not to file charges, citing insufficient evidence to support a prosecution.

“After a thorough review of the case, we determined that the actions of the parents didn’t meet the threshold for criminal negligence,” Adel said in a press release. “While the situation is undoubtedly tragic, our priority is to ensure that any legal action taken is both just and supported by the evidence.”
