POLICY WIRE — St. Paul, Minnesota — A federal appeals court has temporarily blocked enforcement of Minnesota’s first-of-its-kind law banning AI-generated sexualized images, following a ruling by the 8th U.S. Circuit Court of Appeals.
The court granted an injunction requested by Elon Musk’s artificial intelligence company, xAI, halting the law as the legal battle continues. The decision came in response to a lawsuit filed just three days before the law was set to take effect on August 1.

The legislation, which passed unanimously in the state Senate and with near-unanimous support in the House, aims to prevent the use of AI to create nonconsensual pornographic content from real photographs. Violators could face civil penalties of up to $500,000, while victims may seek damages. xAI argued the law violates the First Amendment, claiming it imposes an overbroad restriction on free expression.
