POLICY WIRE — Austin, Texas — A Venezuelan man who was shot by an Immigration and Customs Enforcement (ICE) officer while delivering a DoorDash order in Austin is currently being held in a detention center with a bullet still lodged in his back, according to his attorney.
The incident occurred on Sunday when Wilber Rafael Garces Perez, 28, was struck in the back after an ICE officer sideswiped his vehicle. He was taken to the hospital, and his family was informed four hours later that he had been transferred to the South Texas Processing Center in Pearsall, about two hours from Austin, his lawyer, Kate Lincoln-Goldfinch, said at a Monday press conference.

Garces Perez spoke by phone during the event, expressing severe pain and stating that the bullet remains in his back near his spine. He described poor medical care and living conditions, including a cold room without a bed. His attorney confirmed he has no access to pain medication at the facility. The Department of Homeland Security stated it is investigating the shooting with the FBI and noted Garces Perez entered the U.S. illegally under the Biden administration with a final removal order.
