Justice Department Challenges Kansas School Policies on Transgender Students

POLICY WIRE — Washington, USA — The U.S. Department of Justice has taken legal action against the school system in Kansas City, Kansas, regarding its policies on transgender students. This move follows an investigation by the Education Department into four districts in Kansas, prompted by a complaint from the Defense of Freedom Institute.

The conservative group alleged that the schools had policies that prevented the disclosure of a student’s transgender status to parents without the student’s consent. Kansas City, Kansas, schools have a policy of using students’ preferred names and pronouns, and they evaluate requests from students who do not wish to involve their parents on a case-by-case basis.

In April, the Education Department found that the four Kansas districts were in violation of the Family Education Rights and Privacy Act. The districts did not agree to the government’s proposed resolution agreements, leading the Education Department to collaborate with the Justice Department to enforce compliance.

The Kansas City, Kansas, district, which serves over 20,000 students, expressed disappointment with the DOJ’s decision to file the lawsuit and declined to comment further due to ongoing litigation. Some states, like Idaho and Iowa, have laws requiring parental notification when students seek to use different pronouns or names as part of their gender transition. Kansas does not have such a law.

President Donald Trump’s administration has taken a firm stance against schools accommodating students based on their gender identity, filing lawsuits and opening investigations into various policies. This latest lawsuit is the first to use FERPA to assert a parent’s right to know about their child’s gender transition, seeking to compel the district to change its policies and grant parents greater access to student records.

Assistant Attorney General Harmeet K. Dhillon emphasized the importance of parental rights, stating that the Department will not tolerate school districts disregarding federal law for radical gender ideology. Kansas’ attorney general, Kris Kobach, has been vocal about his concerns over school policies regarding transgender students, arguing that parents should be informed about such significant aspects of their children’s well-being.

Advocates for LGBTQ+ students argue that coming out as transgender can lead to severe consequences at home, including being disowned. Meanwhile, critics like Kobach believe that parents should not be kept in the dark about their children’s gender identity. The Department of Education recently announced that the Topeka district had agreed to rescind any guidance preventing schools from informing parents, while Olathe and Shawnee Mission public schools may face a loss of federal funding for refusing to comply voluntarily.
